TERMS OF SERVICE: CHIC EMBROIDERY & INK

OVERVIEW

Welcome to Chic Embroidery & Ink! The terms "we", "us" and "our" refer to Chic Embroidery & Ink. This website and our services are provided to you, the customer, subject to your acceptance of these Terms of Service and our Privacy Policy. Our store is hosted on Shopify Inc., providing us with the e-commerce platform that allows us to sell our products to you.

SECTION 1 - ACCESS AND CAPACITY

By agreeing to these Terms, you represent that you are at least the age of majority (18 years in South Africa). If you are a minor, you represent that you have the consent of your parent or legal guardian to use this site. You agree to provide current, complete, and accurate information for all account registration and purchases.

SECTION 2 - OUR PRODUCTS & REPRESENTATION

We strive to display the colors and textures of our embroidery threads and ink prints as accurately as possible. However:

  • Screen Variance: We cannot guarantee that your device’s display of any color will be 100% accurate.

  • Handmade Nature: Due to the bespoke nature of embroidery and printing, slight variations may occur between items.

  • Availability: We reserve the right to limit the sales of our products to any person or geographic region (including specific provinces within South Africa).

SECTION 3 - CUSTOM ORDERS & CANCELLATIONS

  • No Returns on Custom Work: In accordance with Section 20 of the CPA, goods that are "special-order" or personalized (such as custom embroidery or specific ink designs) are not eligible for return or refund unless they are physically defective.

  • Order Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to decline an order if we cannot fulfill the customization requirements or if there is an error in pricing.

SECTION 4 - PRICING AND BILLING

  • VAT: Unless otherwise stated, all prices are in South African Rand (ZAR).

  • Changes: Prices for our products are subject to change without notice.

  • Payment: We use secure payment gateways (e.g., PayFast/Yoco/Shopify Payments). By submitting an order, you warrant that you are authorized to use the chosen payment method.

SECTION 5 - SHIPPING AND DELIVERY

  • Risk: While we use reliable South African couriers, the risk of loss passes to you once the package is handed to the carrier.

  • Timelines: Delivery dates are estimates. We are not liable for delays caused by "Force Majeure" events, including but not limited to load shedding, civil unrest, or port delays.

SECTION 6 - INTELLECTUAL PROPERTY

All content on this site, including the "Chic Embroidery & Ink" brand, logos, and custom design templates, is the property of Chic Embroidery & Ink and is protected by South African and international copyright and trademark laws. You may not reproduce or use our designs for commercial resale without express written permission.

SECTION 7 - CUSTOMER FEEDBACK & SUBMISSIONS

If you send us creative ideas or photos of your finished custom products ("Feedback"), you grant us a non-exclusive license to use these for marketing purposes (e.g., on our Instagram or Website), unless you explicitly request otherwise in writing at the time of submission.

SECTION 8 - PROHIBITED USES

In addition to other prohibitions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any South African provincial or national regulations; (d) to submit false or misleading information regarding a custom order.

SECTION 9 - WARRANTY & LIMITATION OF LIABILITY

  • Statutory Warranty: Nothing in these Terms limits your rights under the South African CPA. All non-custom goods carry an implied 6-month warranty against defects.

  • Limitation: To the extent permitted by law, Chic Embroidery & Ink shall not be liable for any indirect, incidental, or consequential damages (including loss of profits) arising from the use of our products.

SECTION 10 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the jurisdiction of the High Court of South Africa in the event of any dispute.
